A Conditional Permanent Resident is who receives a conditional green card that valid for 2 years after applying a green card based on marriage (when marriage is less than 2 year) or entrepreneurs. Conditional permanent card cannot be renewed. People with marriage based conditional residency must apply remove of conditions by filing Form I-751, Petition to Remove Conditions on Residence 90 days before the green card expiration date. And the investor based conditional permanent resident must file Form I-829, Petition by Investor to Remove Conditions on Permanent Resident Status.

Purpose of conditional residency

The reasoning behind conditional permanent residency is to prevent sham marriages. Conditional residency gives USCIS a second time to review the validity of the marriage. The remove of condition process requires evidence from each year after the conditional green card is granted to prove that the marriage was entered in good faith. Applicants can file jointly or by themselves depends on their situations. Once the remove of condition approved, applicants will receive a ten year green card.
