An Undocumented Alien is a non-U.S. national who is present in the United States, but has not been paroled by an officer, or did not enter via a legal port of entry, or who legally entered, but then overstayed their visa. Undocumented aliens are unlawfully present in the U.S. and may be subject to deportation.
Certain undocumented aliens who were brought to the U.S. as minors by their parents may be eligible for a work permit. (See DACA).
