Undocumented Alien

A non-U.S. national who is present in the United States, but has not been paroled by an officer, or did not enter via a legal port of entry, or who legally entered, but then overstayed their visa is known as an undocumented alien, or undocumented immigrant. Undocumented aliens are unlawfully present in the U.S. and may be subject to deportation.

Certain undocumented aliens who were brought to the U.S. as minors by their parents may be eligible for a work permit. (See DACA).
